Sentencing in Man from Jimmit: Fines and Suspended Sentences Issued in Firearms Case
Magistrate Hansel Valarie has delivered a mixed verdict in a firearms-related case, imposing a $5,000.00 fine and a suspended jail sentence against a 25-year-old individual from Jimmit. Kyle Randolph Johnson, along with co-defendants Delon Vincent Victorine, Daron Sammy Sabaroche, and Kemwa Richards, faced charges of possessing a Glock 43 pistol and six rounds of 9mm ammunition without a valid firearm license.
While Johnson pleaded guilty, his co-defendants maintained their innocence. The incident unfolded on November 4, 2023, during a police patrol in the Castle Bruce area. PC Laville observed a Silver Honda CRV, leading to the interception of the vehicle. Upon approach, Johnson was accused of discarding an object, later revealed to be a firearm during a search conducted at first light.
During the court hearing, attorney Wayne Norde advocated for leniency, emphasizing Johnson’s lack of criminal history, gainful employment, and cooperation with the investigation. Norde proposed an alternative to custodial sentencing, suggesting a fine and suspended sentence to address the gravity of the offense while allowing Johnson to fulfill his responsibilities as a father.
However, Magistrate Valarie argued for a custodial sentence, citing the seriousness of possessing a loaded firearm. Despite this stance, the court acknowledged mitigating factors, including Johnson’s guilty plea, first-time offender status, and family responsibilities.
Ultimately, the court opted for a $5,000.00 fine, payable by April 2024, and a two-year suspended prison sentence for each charge. Notably, the cases against the other three defendants were dismissed for want of prosecution, as the prosecution offered no evidence against them.
